No Reserve Auction Acknowledgment

Tyler Grace Auctions LLC conducts this as a no reserve auction. There is no guarantee on price. Items may sell to the highest bidder for any amount, and Tyler Grace Auctions LLC may sell items individually, in groups, as miscellaneous box lots, or in any manner it determines appropriate.

Consigned Items

The consignor consigns the listed items to Tyler Grace Auctions LLC for sale. Items not individually listed that are found in bulk lots, miscellaneous boxes, containers, drawers, cabinets, or within other consigned property may also be included in the auction. Tyler Grace Auctions LLC, at its sole discretion, may offer items through a no reserve auction, reserve auction, straight sale, grouped lots, individual lots, or another method it determines appropriate. This may occur without additional notice to the consignor. No item may be withdrawn after it is accepted for consignment without the express written consent of Tyler Grace Auctions LLC. Broken items will not be accepted and may be disposed of. Items that were not approved or are considered unsellable may be returned or disposed of at the auctioneer's sole discretion.

Commission

Tyler Grace Auctions LLC will retain 45% of the hammer price for items picked up off-site and 25% of the hammer price for items dropped off at the Tyler Grace Auctions physical location. These commission rates apply to items selling for $10.01 or more. Items selling for $10.00 or less are subject to a 50% commission. The buyer's premium is retained by Tyler Grace Auctions LLC and is not included in consignor proceeds. Hammer price means the highest actual bid placed.

Payment

Checks are cut on the Friday of the week in which the 15th business day falls. The 15-business-day period begins after payment has been received from the purchaser for all consigned items. Please allow up to 30 days for unforeseen delays, slow mail, or returned mail. Checks may be reissued after 45 days without a fee. A check reissued before 45 days is subject to a $35 stop-payment fee. Tyler Grace Auctions LLC is not responsible for circumstances outside its control.

Unsold Items

Tyler Grace Auctions LLC is not liable for incidental or consequential damages resulting from a purchaser's failure to pay. Unsold items may, at the sole discretion of Tyler Grace Auctions LLC, be relisted, donated, discarded, or otherwise disposed of without further notice to the consignor.

Items of Little or No Value

Tyler Grace Auctions LLC may discard items that, in its opinion, are damaged, inappropriate, unsafe, or of little to no value. Items considered junk may be subject to a disposal fee of up to $200. The fee may be deducted from auction proceeds or invoiced directly to the consignor if the proceeds are insufficient.

Indemnification

The consignor agrees to indemnify and hold harmless Tyler Grace Auctions LLC, its auctioneer, employees, volunteers, agents, and representatives from claims, damages, lawsuits, liabilities, losses, costs, or expenses arising from ownership disputes involving consigned items; damage to consigned property during loading, unloading, transportation, storage, cataloging, or sale; injury, loss, or damage associated with the consigned items; or a breach of this agreement by the consignor.

Agreement

By signing, the consignor acknowledges that they have read, understand, and agree to all terms in this Consignment Agreement and that the information submitted is complete and accurate to the best of their knowledge.
